Overview

What ESI compliance involves

ESI applies to factories and establishments with 10 or more employees (20 in some states) earning up to Rs 21,000 a month (Rs 25,000 for persons with disabilities).
The employer contributes 3.25% of wages and deducts 0.75% from the employee - a total of 4% goes to ESIC each month.
Contributions for a month must be paid by the 15th of the following month through the ESIC portal.
Every covered employee gets an Insurance Number (IP number) and an e-Pehchan card, which is their access to ESI hospitals and benefits.

Benefits

Why founders hand us their ESI cycle

Open each benefit to see what it means for you.

Never a late contribution

The 15th comes around fast. We run a fixed monthly rhythm - payroll data in, ECR out, challan paid - so interest and damages never enter the picture.

Wage data done properly

Overtime, conveyance, special allowances - what counts as wages for ESI is its own subject. We compute on the correct base, not just basic salary.

New joiners and exits tracked

IP registrations for new hires and timely updates when people leave. Your ESI records always match your actual headcount.

Inspection-ready records

Contribution history, wage registers, and IP declarations kept in order - so an ESIC inspection is a non-event.

Documents

What documents do you need for ESI Return Filing?

Clear, current documents matter more than a long checklist. Names, dates of birth and addresses should match across every record — that's what the MCA checks first. Tick what you already have below.

0 documents marked ready Tick what you already have. This checklist resets when you leave the page.

What is a CIN?

Every Private Limited Company gets a unique 21-character Corporate Identification Number from the MCA. It's proof your company legally exists. You'll need it for bank accounts, tax filings, and contracts. We handle the entire application — you just provide the documents above.

Not sure if your documents are ready?

Send us what you have. A ComplyKart expert will review them for free and tell you exactly what's missing — no obligation.

Questions Founders ask us about documents

What if my address proof is old?

Utility bills and bank statements must be less than 2 months old. If yours are older, get a fresh copy — the MCA rejects stale proofs.

Do I need original documents?

No. Clear scans or photos work for the entire process. We never ask you to courier originals.

What if directors live in different cities?

That's normal. Each director uploads their own documents separately. Our system keeps everything organised.

I'm outside India. Can I still register a company?

Yes. India allows 100% foreign ownership in most sectors, and the entire process happens online. You need one Indian resident director, and your passport + address proof must be apostilled — we'll guide you through both. NRI founders and foreign investors do this with us regularly.

Check if you're eligible →

How long does registration actually take?

7 to 10 working days from the day your documents are verified. Name approval takes 2-3 days, MCA incorporation another 5-7. We track every stage and update you.

Can I start if I'm missing one document?

Yes. Start now with what you have — we begin name reservation and DSC while you arrange the rest. Most founders are missing one proof; it rarely blocks the timeline.

Process

ESI Return Filing process — step by step

You’ll see each stage, what’s pending and what we need from you — so filings don’t bounce back.

Step 1 of 5

We verify your ESIC coverage

We check that your establishment is registered and which employees are covered. ESIC applies to establishments with 10 or more employees in covered areas (20 or more in some states), on wages up to ₹21,000 per month.

Monthly wage data is collected

You share the month's wage register, new joiners, and exits. Missing a new joiner here is the most common error — their contributions then show as short when ESIC cross-checks.

Contributions are calculated

Employer contribution is 3.25% and employee contribution is 0.75% of wages, calculated per employee up to the ₹21,000 monthly wage ceiling. Employees earning above the ceiling in a month are excluded from that month's contribution.

Challan is generated and paid

We generate the monthly challan on the ESIC portal and you pay it online. The deadline is the 15th of the following month — late payment attracts interest and damages, so we aim to file in the first week.

Return is filed and records are kept

The monthly contribution details are submitted on the ESIC portal and you receive the filed challan and confirmation for your records. We also flag employees approaching the wage ceiling so their coverage status stays accurate.

01

Monthly, not occasional

ESI is a monthly discipline. We treat it like one - a fixed process with a fixed date, not something squeezed in when so...

02

We speak payroll

Our team works with salary registers daily. Wage definitions, arrears, bonuses - the edge cases are handled, not guessed...

03

One vendor for PF and ESI

Most clients run both through us. One payroll input, two filings out, one summary in your inbox.

Monthly, not occasional: ESI is a monthly discipline. We treat it like one - a fixed process with a fixed date, not something squeezed in when someone remembers.

For NRI founders & foreign investors

If a founder or investor is outside India

You don't need to fly down. Most of our foreign-founder incorporations are completed without the founder ever visiting India — 100% foreign ownership is allowed in most sectors, and the entire process happens online.

Before you start

  • 100% foreign ownership is allowed in most sectors — no Indian partner needed
  • One Indian resident director is required by law — we help you find a compliant way forward
  • Check whether your sector permits automatic-route foreign investment
  • Your passport + address proof need an apostille, not an embassy visit
  • Map ownership, beneficial ownership and pricing early

After incorporation

  • Receive funds through permitted banking channels
  • Complete RBI/FEMA reporting (FC-GPR, FLA) and keep the bank evidence
  • Coordinate tax and ongoing compliance advice early

By the 15th of the following month. Late payment attracts interest and can invite damages from ESIC, so we work to a 10th-of-month internal deadline.

Employees earning up to Rs 21,000 per month (Rs 25,000 for persons with disabilities) in covered establishments. Once covered, an employee stays covered until their wages cross the threshold in a contribution period.

3.25% employer share plus 0.75% employee share, on applicable wages. The rates are set by ESIC and apply uniformly.

They are separate laws with separate thresholds. Having PF does not exempt you from ESI, and vice versa.

Interest accrues on the delayed amount, and ESIC can levy damages. Repeated defaults can lead to prosecution. If you have missed months, we help you regularise the backlog.

No. If the establishment and the employee's wages fall within coverage, ESI is mandatory - neither side can opt out.

Basic KYC - Aadhaar, bank details, nominee details, and a photograph. We register the IP and the employee receives an e-Pehchan card.

The old half-yearly return system was discontinued. Compliance today is the monthly contribution filing through the ESIC portal, which is what we handle.
