Overview

How patent renewal works in India

A granted Indian patent is valid for 20 years from the filing date, subject to annual renewal fees.
Renewal fees are payable each year before the anniversary of the filing date, starting from the third year.
There is a grace period of six months to pay late, with an additional fee — after that, the patent lapses.
A lapsed patent can be restored through a restoration application, but only within a limited window and at the Controller's discretion.
Fees differ by applicant type — individuals, startups, small entities and large entities pay different rates.

Indian patents run for 20 years from the filing date, and renewal fees are payable annually starting from the 3rd year. We verify your exact due year from the Patent Office records.

Pay before the due date

We pay the annual renewal fee to the Patent Office before the deadline. The fee depends on your entity category and the year — paying on time keeps it cheapest.

Missed it? Use the 6-month grace period

The Patents Act gives you 6 extra months to pay with an extension fee. Miss that too and the patent lapses — though restoration can be sought within the statutory window, it is slow and uncertain.
