EPF Registration for Employers

Most founders discover EPF a few months late. The team grows past twenty, payroll keeps running, and somewhere in a quarter-end review someone asks whether PF has been set up. It has not. The registration itself is straightforward; the arrears are not — 12% annual interest, damages under Section 14B that can reach the full amount of the dues, and a file that stays open until every month is regularised. The EPF Act is from 1952 and built to be self-applying. It does not wait for a notice. The em

EPF registration — an overview

The Employees' Provident Funds and Miscellaneous Provisions Act, 1952 — now transitioning under the Code on Social Security, 2020 — provides provident fund, pension and deposit-linked insurance for employees in factories and other establishments. It is administered by the Employees' Provident Fund Organisation (EPFO) under the Ministry of Labour and Employment. Three schemes sit under it: the EPF Scheme, 1952 (retirement savings), the Pension Scheme, 1995 (monthly pension after retirement), and the Deposit Linked Insurance Scheme, 1976 (lump sum to the family on death in service).

Coverage is employer-driven and establishment-wide. The employer registers, obtains an establishment code, and every eligible employee gets a member account linked to a Universal Account Number. Contributions are deducted monthly, matched by the employer, and deposited with EPFO. Members earn interest on the PF balance (8.25% for FY 2023-24), build pensionable service for EPS, and are insured under EDLI from day one.

Two features catch first-time employers off guard. First, the Act is self-applying — no licence to wait for; the clock starts the moment you meet the threshold. Second, coverage is sticky: under Section 1(5), once the Act applies it keeps applying even if headcount falls below twenty. The twenty-person test is an entry gate, not a continuing condition.

---

Is EPF registration right for your business?

You must register now if: you employ 20 or more persons (including contract and casual workers) in a Schedule I industry or notified class — registration is due within one month of crossing. Cinema theatres are covered at 5 or more. And if your headcount touched 20 even briefly in the past, you are still covered under Section 1(5).

Consider voluntary registration if: you have fewer than 20 employees but want EPF as a retention tool (employer plus a majority of employees apply to the Central Provident Fund Commissioner), or a key client or tender requires PF-compliant vendors.

You are likely out if: you genuinely have no employees — only partners, unsalaried directors, or genuine off-site contractors (careful: on-premises contract labour counts) — or your establishment is exempted under Section 16.

---

What must be decided before you register

Who counts as an employee. The threshold counts all persons employed, including contract labour. Employees earning basic wages plus dearness allowance up to ₹25,000 per month are mandatorily covered; those above can be enrolled voluntarily with employer consent — decide deliberately, because excluding higher-paid employees now and adding them later creates two classes of members.

Whether to seek voluntary coverage below 20. At 14 employees and hiring aggressively, registering voluntarily now avoids the scramble when you hit 20 mid-quarter. Payroll, UAN generation and ECR discipline are already running.

Who the authorised signatory is. Registration requires the DSC of the proprietor, partner or director who will sign filings. Decide before you start — changing signatories mid-process is where most registrations stall.

How wages are structured. Contributions run on basic plus DA plus retaining allowance, and inspectors can reclassify universally-paid allowances as basic during audits. If your salary structure keeps basic artificially low, understand the risk before your first ECR.

Advantages of EPF registration

A real retirement corpus for employees

Twelve percent from the employee plus the employer's match, compounding at EPFO-declared rates, builds a meaningful sum over a career. For most private-sector employees, EPF is the largest financial asset they will ever hold.

A pension that builds in the background

The 8.33% diverted to EPS accumulates pensionable service — ten years earns a monthly pension from age 58 (₹1,000 minimum). Modest, guaranteed, at no extra cost.

EDLI: a safety net at no deduction from salary

The Deposit Linked Insurance Scheme pays a lump sum to the nominee on death in service — linked to the PF balance, capped at ₹7.3 lakh — with the entire premium paid by the employer.

Genuinely favourable tax treatment

Employee contributions qualify for 80C deduction up to ₹1.5 lakh; interest is tax-free after five continuous years of service. Few instruments combine deduction, tax-free interest and employer matching.

The compliance question, settled permanently

An establishment code, regular ECRs and clean member records close the door on Section 7A inquiries. Operating uncovered past the threshold leaves an open liability compounding with interest and damages.

Stronger hiring and retention

For experienced hires, PF is a hygiene expectation. Voluntary registration at 12 or 15 employees signals the company intends to do things properly.

Withdrawals when life happens

Partial withdrawals for housing, medical emergencies, marriage and education — with UAN and KYC seeded, most claims settle directly to the bank account.

Documents required

Establishment identity:

  • PAN of the establishment (company, firm, society or proprietorship)
  • Certificate of incorporation or registration deed, with MOA/AOA for companies and partnership deed for firms
  • Shops and Establishment certificate, GST certificate, or any government-issued licence for the establishment

Authorised signatory:

  • Aadhaar and PAN of the proprietor, partner or director signing the application
  • Digital Signature Certificate of the authorised signatory

Address and banking:

  • Address proof of the registered office — utility bill not older than two months
  • Rent or lease agreement if the premises are not owned
  • Cancelled cheque or bank statement, with bank name, branch, IFSC and address

Workforce details:

  • Salary details of employees and the number of employees on the rolls
  • First sale bill or licence proof as evidence of the date of commencement — this fixes the coverage start date
  • Balance sheet details where applicable

EPF registration process — step by step

Step 1 — Confirm coverage and fix the applicability date

Identify the date you crossed 20 employees. Registration is due within one month of that date. Voluntary applicants skip this step.

Step 2 — Gather documents and the DSC

Collect the establishment, signatory, address and bank documents, and ensure the authorised signatory's Digital Signature Certificate is valid and in their name.

Step 3 — Register on the Shram Suvidha portal

File through the Unified Shram Suvidha Platform: establishment details, employment strength, wage details and signatory particulars, then upload documents and sign with the DSC.

Step 4 — Receive the establishment code

EPFO allots the establishment code — the PF code number for all future compliance. Keep the allotment letter; banks, auditors and tender authorities will ask for it.

Step 5 — Log in to the EPFO employer portal

Access the employer e-Sewa portal with the establishment ID. UAN generation, ECR filing and member approvals all run from here.

Step 6 — Generate UANs for members

Under Member > Register Individual, enter each employee's PAN, Aadhaar, bank details and joining date, then approve. Existing UANs from previous jobs must be declared — one person, one UAN.

Step 7 — Seed KYC and activate

Seed Aadhaar, PAN and bank details against each UAN; members activate on the member portal. Aadhaar seeding can now be done via the UMANG app where details match, without EPFO approval.

Step 8 — File the first ECR

File the Electronic Challan cum Return for the first month — member-wise wages and contributions — and pay by the 15th of the following month. From here, ECR is a monthly discipline.

---

How long does it take?

| Stage | Typical time | |---|---| | Document collection and DSC readiness | 2–5 working days | | Shram Suvidha application to establishment code | 5–15 working days | | UAN generation for the first batch of members | 1–3 working days after code allotment | | KYC seeding and activation | 3–7 working days | | First ECR filing | Due by the 15th of the month following coverage |

Realistic end to end: two to four weeks from a complete document set. Delays almost always come from mismatched names across PAN, Aadhaar and bank records — resolve those before filing, not after.

---

Fees and what it costs

Government fees for EPF registration are nil — no statutory charge. The real costs are the contributions themselves and professional fees for setup and monthly filing. ComplyKart works in three bands:

| | Starter | Growth | Scale | |---|---|---|---| | Best for | Up to 20 members | 21–100 members | 100+ members | | Registration + first ECR | Included | Included | Included | | Monthly ECR filing | Add-on | Included | Included | | UAN generation & KYC | Included | Included | Included | | Annual compliance calendar | — | Included | Included | | Dedicated compliance manager | — | — | Included |

Monthly cost per member at the ceiling: 12% towards EPF/EPS plus 0.5% EDLI and 0.5% admin — roughly 13% in total. On a ₹25,000 wage, about ₹3,250 from the employer, matched by ₹3,000 deducted from the employee.

---

How ComplyKart helps

Consulting. We confirm coverage — including the contract-labour counting question and state notification position — fix your applicability date, and advise on voluntary registration where it makes sense.

Documentation. We assemble the establishment file, verify name consistency across PAN, Aadhaar and bank records, and prepare the DSC.

Filing. We file the Shram Suvidha registration, track the establishment code, generate UANs, seed KYC, and file the first ECR.

Follow-up. Monthly ECR filing, new-joiner UANs, exit-date marking on separations, and a compliance calendar that keeps the 15th from being a surprise.

What we do not do: we do not represent you in Section 7A adjudication or Tribunal appeals — those need a practising professional briefed on your facts. We do not advise on restructuring wages to reduce contributions; we will tell you plainly where your structure creates exposure.

---

What happens after registration

Within 30 days: establishment code active, UANs generated for all members, KYC seeded, first ECR filed and paid. Generate UANs for new joiners in their joining month — in the same ECR cycle, not three months later.

Within 6 months: the monthly rhythm is set — payroll exports feed the ECR, challans paid by the 15th, records current. Complete e-nominations for every member; without a nominee, EDLI and PF settlement on death becomes a paperwork ordeal for the family.

---

Recurring compliance

Monthly: file ECR and pay contributions by the 15th of the following month. Mark dates of joining and exit accurately — pensionable service and EDLI eligibility both depend on them.

Annual: EPFO declares the interest rate each year (8.25% for FY 2023-24), credited on the year's closing balance. No separate annual return beyond the twelve ECRs — but keep wage registers, attendance and contribution records ready for inspection.

Event-based: generate UANs for new joiners; process transfers through Form 13 when employees carry a UAN from a previous employer; support withdrawals (Form 19 for PF, Form 10C for pension, Form 31 for advances) when members apply.

---

The 20-employee threshold — the rule that decides everything

Section 1(3) applies the Act to factories in Schedule I industries employing 20 or more persons, and to other notified classes of establishments. Three things about this threshold are routinely misunderstood.

It counts heads, not salaries. Contract labour, casual workers and part-timers all count — the only question is whether they work in or in connection with the establishment.

It is a one-way door. Under Section 1(5), once the Act applies it keeps applying even if employment falls below twenty. Cross 20 in your peak season and you are covered for the lean months too, with ECRs due every month.

Special thresholds exist. Theatres are covered at 5 or more employees; co-operative societies have their own thresholds. The Ministry has clarified the threshold remains 20 with no proposal to reduce it to 10. [NEEDS VERIFICATION: confirm no subsequent notification has altered this position at publish.]

Registration is due within one month of becoming covered. Dues, interest and damages run from the date of coverage — not from the date you finally register.

---

The UAN — one number for a working life

The Universal Account Number is a 12-digit number allotted to every EPF member, staying with the person across employers, cities and decades. Every PF account they ever hold links to it. When an employee joins with an existing UAN, do not generate a new one — link their new member ID through Form 13 and transfer the balance.

Three disciplines make it work: generate it in the joining month, seed Aadhaar, PAN and bank account against it, and get the member to activate it and file an e-nomination. EPFO's 2025 updates — bulk UAN generation in revised Form 13, face-authentication activation, and Aadhaar seeding through UMANG without departmental approval — removed most of the old friction. What remains is on the employer: complete, matching KYC data.

One person, exactly one UAN. Duplicates can be merged and deactivated — but leaving them creates transfer failures years later, usually discovered when the employee tries to withdraw.

The September 2026 ceiling change — S.O. 5109(E)

On 17 September 2026, the Ministry of Labour and Employment notified S.O. 5109(E), raising the statutory wage ceiling for mandatory EPF coverage from ₹15,000 to ₹25,000 per month — the first revision since September 2014. Issued under the Code on Social Security, 2020, it covers the EPF, EPS and EDLI schemes together. Contribution rates did not change; only the wage base did.

The numbers: at the ceiling, each 12% share rises from ₹1,800 to ₹3,000 per month; of the employer's share, ₹2,083 (8.33%) now flows to EPS and ₹917 to the provident fund. EDLI's maximum rises from ₹75 to ₹125. Maximum employer outgo at the ceiling is ₹3,250 per member per month.

Who is newly covered: employees earning ₹15,001–₹25,000 who were excluded purely on wage grounds now fall within mandatory coverage — the government estimates 51 lakh-plus additional employees. If your payroll master still flags people as "excluded" only because they earned above ₹15,000, re-test everyone against ₹25,000 before the next ECR.

September 2026 was a split month. The change took effect mid-month: old ceiling for 1–16 September, new ceiling from 17 September, with the ECR due by 15 October 2026. EPFO issued 48 FAQs on the transitional computation; from October 2026, full months run on the new ceiling.

No wage cuts allowed. The Ministry directed employers not to reduce statutory wages to absorb the higher burden, nor recover the employer's increased share from employees. Where wages fall inside the new ceiling, the employee's own 12% applies on the higher base — take-home shifts, but that is their own contribution.

The ESI ceiling did not move. ESIC's ₹21,000 ceiling is unchanged, creating a new band — employees earning ₹21,001–₹25,000 are now in EPF but outside ESI. Payroll must handle the two ceilings independently.

---

EPF vs ESI — which applies to you?

Most establishments that cross one threshold eventually cross both. The two laws run in parallel with different gates (both now transitioning under the Code on Social Security, 2020):

| | EPF | ESI | |---|---|---| | Employee threshold | 20 or more | 10 or more | | Wage ceiling | ₹25,000 (basic + DA) | ₹21,000 (gross wages) | | Employee contribution | 12% | 0.75% | | Employer contribution | 12% + EDLI + admin | 3.25% | | Core benefit | Retirement savings + pension + insurance | Medical care + cash benefits | | Monthly filing | ECR by the 15th | Challan by the 15th; half-yearly returns | | Member identifier | UAN (12 digits) | Insurance number (10 digits) |

With 10–19 people, ESI likely applies while EPF does not — unless you opted for voluntary EPF coverage. At 20+, both apply. Budget for both from the hiring plan, not after the first notice.

---

Common mistakes employers make

Counting only permanent employees. Contract and casual workers count towards the 20. Excluding them is the single most common reason establishments discover coverage late.

Treating the threshold as a continuing test. It is not. Once covered, always covered — file ECRs even in months when headcount dips.

Under-declaring wages. Splitting basic pay into allowances to shrink contributions invites reclassification during inspection, with arrears, interest and damages on the difference.

Generating UANs late. Members without UANs in the ECR cycle create reconciliation gaps that surface during withdrawals and transfers.

Missing the 15th. The ECR deadline is monthly and unforgiving. Interest runs at 12% per annum from the due date, and Section 14B damages are graded by the length of default — up to 100% of the arrears.

Ignoring exits. Not marking the date of exit leaves ghost members in the system and distorts pensionable service records.

---

Penalties and what delay costs

  • Interest (Section 7Q): 12% per annum on delayed contributions, from the due date to the date of payment.
  • Damages (Section 14B): graded by the period of default — 5% per annum for short delays, rising to 25% per annum beyond 6 months, effectively up to 100% of the arrears.
  • Determination of dues (Section 7A): an officer can determine the amount due for any period on the basis of available records — including on the employer's failure to produce records.
  • Prosecution: failure to pay contributions or submit returns can lead to imprisonment up to one year and fines under Sections 14(1A) and 14(2A).

FAQs

1. Is EPF registration mandatory for a company with 20 employees?

Yes. Under Section 1(3) of the EPF & MP Act, 1952, any establishment in a covered industry employing 20 or more persons must register within one month of crossing the threshold. The obligation is self-applying — it does not wait for an EPFO notice.

2. Do contract employees count towards the 20-employee threshold?

Yes. The threshold counts all persons employed in or in connection with the work of the establishment, including contract labour, casual workers and part-timers. Only the wage ceiling (₹25,000 basic + DA) decides individual coverage.

3. What is the salary limit for EPF deduction?

Employees drawing basic wages plus dearness allowance up to ₹25,000 per month are mandatorily covered. Employees above ₹25,000 can be enrolled voluntarily if both the employee and employer agree. The employer's EPS diversion is capped at ₹2,083 per month (8.33% of ₹25,000).

4. What is the EPF contribution percentage?

12% of wages each from the employee and the employer. Of the employer's 12%, 8.33% goes to the Employees' Pension Scheme (capped at ₹2,083) and 3.67% to the provident fund. The employer additionally pays 0.5% EDLI and 0.5% admin charges — about 13% in total.

5. What is UAN and why does it matter?

The Universal Account Number is a 12-digit lifelong identifier for every EPF member. It links all PF accounts across employers, enables online claims and transfers, and stays with the employee for life. Employers generate it in the joining month and seed KYC against it.

6. When is the ECR due every month?

By the 15th of the following month — both the return and the payment. For January's wages, the ECR and challan are due by 15 February. Late payment attracts 12% annual interest plus graded damages under Section 14B.

7. Can a company with 10 employees register for EPF voluntarily?

Yes. Establishments below 20 employees can opt for voluntary coverage when the employer and a majority of employees agree and apply to the Central Provident Fund Commissioner. The same contribution and filing discipline applies once accepted.

8. What happens if headcount falls below 20 after registration?

Nothing changes. Section 1(5) provides that once the Act applies to an establishment, it continues to apply even if employment falls below twenty. ECRs must be filed every month regardless.

9. What are the three schemes under the EPF Act?

The Employees' Provident Funds Scheme, 1952 (retirement savings with interest), the Employees' Pension Scheme, 1995 (monthly pension after 10 years of eligible service, from age 58), and the Employees' Deposit Linked Insurance Scheme, 1976 (lump-sum payment to the family on death in service).

10. How is the employer's 12% divided?

8.33% of wages (capped at ₹2,083 per month) goes to EPS; the remaining 3.67% goes to the EPF account. For members above the ₹25,000 ceiling enrolled voluntarily, the employer may contribute the full 12% to EPF where EPS membership is not applicable.

11. What is EDLI and who pays for it?

The Employees' Deposit Linked Insurance Scheme, 1976 provides life insurance linked to the PF balance (up to ₹7.3 lakh) payable to the nominee on death in service. The employer pays the entire 0.5%; nothing is deducted from the employee.

12. What documents are needed for EPF employer registration?

PAN of the establishment, incorporation or registration certificate, MOA/AOA or partnership deed, Shops and Establishment or GST certificate, address proof of the office, cancelled cheque, Aadhaar and PAN of the authorised signatory, and the signatory's Digital Signature Certificate.

13. How long does EPF registration take?

Typically two to four weeks from a complete document set: 5–15 working days for the establishment code after filing on Shram Suvidha, then 1–3 days for UAN generation plus KYC seeding, with the first ECR due by the 15th of the following month.

14. What is the penalty for late EPF payment?

Interest at 12% per annum under Section 7Q from the due date, plus damages under Section 14B graded from 5% to 25% per annum based on the length of delay. Officers can also determine dues under Section 7A, and persistent default can lead to prosecution.

15. Can an employee withdraw PF while still employed?

Partial withdrawals (advances) are permitted for specified purposes — housing, medical treatment, marriage, education — under the scheme's provisions, through Form 31. Full withdrawal through Form 19 is available on retirement or after two months of unemployment.

16. What is Form 13 in EPF?

Form 13 is the transfer claim form used when a member changes jobs. It moves the PF balance from the previous employer's account to the new one, linked through the same UAN. The 2025 revision of Form 13 enables bulk generation and faster automated approvals.

17. Is EPF interest taxable?

Interest is tax-free if the employee completes five continuous years of service. Employee contributions qualify for deduction under Section 80C up to ₹1.5 lakh per year. Withdrawals before five years are taxable as per the applicable slab.

18. What is CPPS in EPF pension?

The Centralised Pension Payment System, rolled out in January 2025, lets EPS pensioners receive their pension in any bank account anywhere in India — earlier, pensions had to be drawn through designated banks in the region of the Pension Payment Order.

19. Do directors count as employees for EPF?

Working directors drawing salary are employees for the purposes of the Act. The threshold counts persons employed, and a salaried director is employed. Non-executive directors receiving only sitting fees are not.

20. What records must an employer maintain for EPF?

Wage registers, attendance records, contribution records, ECR filings and challans, member KYC data and nominations. These must be produced during inspections and Section 7A inquiries — the department can determine dues from available records if you cannot produce your own.

8.33% of wages (capped at ₹2,083 per month) goes to EPS; the remaining 3.67% goes to the EPF account. For members above the ₹25,000 ceiling enrolled voluntarily, the employer may contribute the full 12% to EPF where EPS membership is not applicable.

The Employees' Deposit Linked Insurance Scheme, 1976 provides life insurance linked to the PF balance (up to ₹7.3 lakh) payable to the nominee on death in service. The employer pays the entire 0.5%; nothing is deducted from the employee.

Partial withdrawals (advances) are permitted for specified purposes — housing, medical treatment, marriage, education — under the scheme's provisions, through Form 31. Full withdrawal through Form 19 is available on retirement or after two months of unemployment.

Form 13 is the transfer claim form used when a member changes jobs. It moves the PF balance from the previous employer's account to the new one, linked through the same UAN. The 2025 revision of Form 13 enables bulk generation and faster automated approvals.

Interest is tax-free if the employee completes five continuous years of service. Employee contributions qualify for deduction under Section 80C up to ₹1.5 lakh per year. Withdrawals before five years are taxable as per the applicable slab.
