What is design registration?
Design is an outward appearance applied to a product. Design registration is used for the shape, pattern, ornaments etc designed by someone and then protected by getting them registered. A design can be anything that is two dimensional or three-dimensional patterns or ornaments etc.A pattern is something that is engraved upon an article which later is used for decoration purpose. By getting some design registered doesn’t preserve the technicality of the article but just the design part of it. The design should be New or Original and not previously published or used in any country before the date of publication for registration. The registration of design is granted for an initial term of 10 years from the date of registration that can be further extended for a period of 5 years. A registered design provides the creator exclusive rights over the use of design.
There are some items that cannot be registered as design such as Labels, Cards, Tokens, Books, Jackets, Calendars, Flags, Mare change in size of article, Similar with existing ones etc.

Novelty check
A design must be new and original — not previously published or registered in India or abroad. We check for prior disclosures that could kill the application before you file.
Prepare and file Form 1
We prepare Form 1 under the Designs Act, 2000, with the design representations and the statement of novelty, and file it with the Designs Office in Kolkata.
Examination by the Controller
The Controller of Designs examines whether the design meets the legal requirements — it must be applied to an article by an industrial process, and must not be a mere mechanical device or trademark.
Reply to objections and registration
Objections, if any, are answered with amendments or arguments. Once accepted, the design is registered and published in the Patent Office Journal.
10 years, extendable to 15
Design protection lasts 10 years from the registration date, extendable by a further 5 years on payment of the extension fee. We track the deadline so your protection never lapses.
