Understanding this document
What is notice to vacate tenant?
A formal written notice asking the tenant to vacate by a date, per the lease terms. It is the legally clean first step before any eviction proceeding — courts expect to see that the tenant was given proper notice and a fair chance.
When do you need it?
As soon as you decide the tenancy must end — respecting the notice period in the agreement (commonly 1–3 months). Send it in a provable way: registered post or email with acknowledgement.
Common mistakes to avoid
- Verbal notice only — impossible to prove when the dispute reaches a lawyer.
- Ignoring the agreement's own notice period and demanding immediate vacation.
- Changing locks or cutting utilities to force exit — illegal even if the tenant is in default.
- No mention of deposit settlement and handover inspection in the notice.
