Understanding this document
What is employee appointment letter?
The appointment letter is the employment contract most Indian companies actually use. It records the role, compensation, probation, notice period, and the rules both sides live by. In a dispute — wrongful termination, unpaid dues, notice pay — this is the first document anyone asks for.
When do you need it?
Every single hire, including founders hiring their first employee. Issue it on or before the joining date, signed by both sides. Backdating appointment letters is a surprisingly common habit and a completely avoidable risk.
Common mistakes to avoid
- Vague notice period ("as per company policy") with no policy actually attached or acknowledged.
- No confidentiality or IP assignment clause — then arguing later that the employee "knew" their work belonged to the company.
- CTC breakup missing: disputes over variable pay and deductions start here.
- Probation terms that never confirm anyone — employees stuck in "extended probation" for a year.
Need it tailored to your company?
Templates cover the standard cases. If your situation has complications — multiple parties, unusual terms, regulatory scrutiny — get it drafted properly. Our CAs, CSs and lawyers do this every day.
