PF and ESI for Restaurants: the ₹25,000 PF Ceiling Change, Contractor Rules and Inspection Readiness

Restaurants with 20+ employees — including contract staff — need PF registration; ESI applies at 10+ in most states. Since 17 September 2026 the PF wage ceiling is ₹25,000 (S.O. 5109(E), Code on Social Security, 2020): staff earning up to ₹25,000 attract 12% + 12% PF. ESI stays at ₹21,000 wages, 3.25% employer, 0.75% employee.

A restaurant owner I know runs a 24-person outlet. PF was "something for later" — until October's payroll nearly doubled his PF bill: half his staff sat in the ₹15,000–₹25,000 band, and the ceiling moved on 17 September. What changed, what it costs, who counts as your employee, and how to stay ready.

What changed in September 2026

On 16 September 2026 the Cabinet approved raising the mandatory PF wage ceiling from ₹15,000 to ₹25,000 a month; the Labour Ministry notified it the next day as S.O. 5109(E) under the Code on Social Security, 2020 — the first revision in twelve years. Rates didn't move: 12% employee, 12% employer (8.33% to pension, 3.67% to PF), plus 0.5% EDLI and 0.5% admin. At the new ceiling: ₹3,000 + ₹3,000 per employee, plus ₹125 and ₹125. Employer outgo: ₹3,250 a month.

Two traps. September 2026's ECR had to be split — old ceiling for the first 16 days, new for the rest. If your accountant didn't split it, ask. And ESI was deliberately untouched: ceiling ₹21,000 (₹25,000 for persons with disabilities), rates 3.25% employer, 0.75% employee.

The Code on Social Security, 2020 has been in force since 21 November 2025, replacing nine old laws including the 1952 EPF Act and the 1948 ESI Act.

Does PF and ESI apply to your restaurant?

PF: 20 or more employees. ESI: 10 or more in most states. Restaurants, hotels, shops and cinemas are expressly in the notified net.

The catch: your contractor's people count toward your headcount. The cleaner, the guard, the agency dishwasher — if they work in or in connection with your establishment, they count. Fourteen on your rolls plus six agency workers is a 20-person establishment in the law's eyes.

Once you cross the line, the clock starts: PF registration within one month of crossing 20, ESI registration within 15 days of becoming applicable. Miss it and you still owe contributions from the date the law applied — plus interest and penalties.

The 50% wages rule — the clause that inflates your PF bill

Under the Code (Section 2(88)), "wages" means basic plus dearness allowance plus retaining allowance. HRA, conveyance and the rest are excluded — but those exclusions cannot exceed 50% of total remuneration. The excess gets added back into wages.

Think of salary like a thali. The Code says the roti and dal — basic plus DA — must make up at least half the plate. Run a 40% basic with 60% allowances to keep PF low, and the law pushes the excess back into the wages bowl; PF is then calculated on the bigger bowl. Many restaurants run this structure because it felt clever under the old regime. Under the Code it backfires — recompute before the next ECR.

What does PF and ESI cost per employee?

A waiter on ₹20,000 wages (basic + DA): PF is ₹2,400 from him and ₹2,400 from you, plus ₹100 EDLI and ₹100 admin — ₹2,600 of your money. ESI on the same ₹20,000: ₹650 from you, ₹150 from him. Roughly ₹3,250 a month of employer cost across both.

One small mercy: employees below ₹176 a day are exempt from the employee's 0.75% ESI share (your 3.25% still applies). The clocks: PF's ECR by the 15th of the following month; ESI within 15 days of the month's end. For your exact monthly hit, run the headcount through the compliance fee calculator; the broader payroll picture is in our payroll compliance guide.

Contractor staff: whose liability is it?

Yours. The principal employer must ensure PF and ESI compliance for contract workers in the establishment. If your housekeeping contractor deducts PF and never deposits it, the demand notice comes to you — his default becomes your arrears.

Three protections: put monthly challan-sharing in the contract and don't release payment until the challans arrive; actually open those challans; keep a withhold clause. A contractor who objects is telling you something.

High attrition is the real compliance killer

Every unrecorded exit becomes a phantom employee in your ECR, and phantom employees attract real demands. Generate the UAN for each joinee, mark the exit date in the month they leave, keep the declarations on file. Appointment letters are now statutory under the Codes.

For seasonal hiring: fixed-term employees earn pro-rata gratuity after one year under the Code — that 11-month festival contract rolling into a second year carries a gratuity tail. The good news: the Codes collapsed the old paperwork — 31 returns to one, 181 forms to 73, 84 registers to 8.

Inspection readiness — what the officer asks for

The inspector's list: registration certificates, monthly ECRs and ESI challans with payment proof, wage and attendance records, your contractor's bills plus his PF/ESI challans for staff at your premises, and appointment letters. Current paperwork means a conversation; lapsed paperwork means a demand.

Penalties are not decorative: PF damages run at 1% per month on delayed contributions, fines up to ₹5,000, imprisonment up to a year; ESI charges 12% annual interest plus fines up to ₹5,000 — all on top of the arrears. Keep your Shops and Establishment registration current too (due within 30 days of starting in most states). Our restaurant FSSAI guide covers the licence side.

Mistakes restaurant owners keep making

  • Counting only the payroll. Contract staff count toward the 20/10 thresholds. Recount with them in.
  • Still using ₹15,000 as the ceiling. It is ₹25,000 since 17 September 2026. Update the payroll master.
  • Thin basic, fat allowances. The 50% rule adds the excess back.
  • No exit dates for departed staff. Phantom employees inflate the ECR.
  • Trusting the contractor's word on challans. Verify monthly, or own his default.
  • Ignoring fixed-term gratuity. One completed year on a fixed-term contract means pro-rata gratuity.

Frequently asked questions

My restaurant has 16 staff. Do I need PF?

Not yet — PF needs 20, counting contract and agency staff on your premises. ESI likely applies at 10+ in most states. The day you hit 20, PF registration is due within a month — plan before the 20th hire.

My head chef earns ₹30,000. Is he covered?

Coverage is at the establishment level, so he is in — but contributions cap at the ₹25,000 ceiling (₹3,000 each). Above that is voluntary.

When are PF and ESI dues payable?

PF's ECR by the 15th of the following month; ESI within 15 days of the month's end. Mark both — late payment is where interest and damages compound.

My cleaning contractor handles his own PF. Am I safe?

Only if you verify. You own his default as principal employer, so collect his monthly PF and ESI challans before releasing payment and keep that in the contract.

Do seasonal staff get gratuity?

Fixed-term employees get pro-rata gratuity after one year under the Code. An 11-month contract renewed into a second year crosses that line.
